¿Qué es una Tutela?
La acción de tutela es un mecanismo expedito que tiene como objetivo la protección de los derechos fundamentales de las personas y que se vean vulnerados de alguna manera por parte de cualquier autoridad. La tutela se usa cuando no existe ningún otro mecanismo que pueda proteger a la persona, o como última instancia, establecido en el artículo 86 de la constitución política de Colombia y reglamentado el Decreto 2591 de 1991.
¿Quién puede presentar una Tutela?
Cualquier persona natural o jurídica, por si misma o por quien actúe a su nombre, para la protección inmediata de sus derechos constitucionales fundamentales, cuando quiera que estos resulten vulnerados o amenazados.
¿Requisitos para presentar una Tutela?
- Los datos de identificación del accionante y del accionado.
- Los hechos que te llevaron a presentar la acción de tutela.
- Los posibles derechos vulnerados.
- La solución que consideras conveniente para proteger tus derechos.
- Las pruebas que evidencien la vulneración de los derechos fundamentales.
- No haber interpuesto una solicitud ante otra autoridad al mismo tiempo, para proteger los derechos vulnerados.
¿Dónde presentar una Tutela?
Toda persona puede presentar una acción de tutela ante los jueces, en todo momento y lugar, mediante un procedimiento preferente y sumario.
Debe ser radicada en cualquier sede judicial de manera física con las copias de ley.
A causa de la actual emergencia desatada por el COVID-19, el Consejo Superior de la Judicatura habilitó la atención virtual a tráves de la página web oficial de la rama judicial y los correos electronicos institucionales. Por lo que se puede radicar tanto la tutelas como el Habeas Corpus directamente en la página. Ver aquí.
Tambien cuenta con una lista de correos electrónicos donde se puede presentar de manera virtual la acción de tutela y el Habeas Corpus, por lo que debes primero identificar el correo electrónico de la región en la que te encuentras. Consulta aquí.

Los correos electrónicos habilitados por el Consejo Superior de Judicatura no podrán usarse para radicar demandas o impulsar procesos judiciales diferentes a las acciones de tutela y habeas corpus.
